"Even if Georgia’s statute were interpreted to allow abortions through-out pregnancy, the statute also imposes three procedural, requirements that restrict access to abortions. First, the Georgia statute demands that all abortions must be performed in a hospital accredited by the Joint Commission on Accreditation of Hospitals. Second, it requires that the procedure be approved by an abortion committee composed of members of the hospital staff. Third, it requires that the performing physician’s judgment be confirmed by independent examinations of the patient by two other licensed physicians. For Georgia’s statute to be constitutional, Georgia must show that its regulations materially further the woman’s interest in health without significantly burdening her right to an abortion. None of these three requirements meet this standard."
