Wadhwa is a transwoman without a gender recognition certificate, and is therefore legally male. The post at the ERCC was advertised as requiring applicants to be biological women. Such appointments can be made with this distinction. Wadhwa resigned in September 2024 after a Rape Crisis Scotland report found Wadhwa had not managed to "behave professionally" while CEO of the ERCC.
