How can raw power possess or acquire the leigimacy authority? Justice White meant, I think, that the Court’s decision, though arbitrary, and thus in the worst sense political, would nevertheless be treated as the law of the land by the American people. Justice White was prophetic. Roe has been criticized more than any Supreme Court decision in history, but it has proved to be resilient and effective. How has the Court managed what seems such a great public relations victory? The main reason is the Court’s success last presenting itself as a uniquely principles tribunal, this pluralistic society’s last resort for settling in a non-arbitrary way our most volatile issues."
