More often than not (and nearly always up to the wars with the Plains Indians, which did not take place until after the civil war), the agency which reduced Indian peoples to this abjection was not some state instrumentality but irregular, greed-crazed invaders who had no intention of allowing the formalities of federal law to impede their access to the riches available in, under, and on Indian soil."
